Just broke up after a 3 yr relationship, she wants to keep the car but i know she wont be able to af

long story short she cheated. i can afford the car seeing as how i moved out of the apt and am now living with my parents again, and the car is under my dads name and hers, so i dont want my dads credit to get ruined, i financed with Rio Grande credit union, i was the one that made the payments on the car. i signed each and every time i made a payment, so heres my options right now, im gona talk to her dad to see if he can convince her to just handed over, or take her to court, can i obtain those recipts with my signature and just say that i want the car handed over to my dad? i mean im being a nice guy about the whole ordeal. but she just wont cooperate with me, i just dont know how to take care of this situation?

Were you married? If you weren%26#039;t, hopefully that will teach you that it is stupid to move in together or share things like cars before you are married and there is no real commitment made between the both of you.



Just let her have it and it will get repossessed or take her to court, im sure you will win.

This is why people never should co-sign on anything. It doesn%26#039;t matter who paid the payments. If she doesn%26#039;t make payments it is your dad%26#039;s responsibility. Since your name is not the original contract there is nothing you can legally do about it.

Who was the primary loan applicant, your dad or ex? Even if she does give up the car, I can imagine that she would no longer want her name on it for fear or bad credit etc., so I recommend refinancing the person off who will not be keeping the car and then the car will only be in that person%26#039;s name and be that person%26#039;s problem. If she wants to argue about it, let it go and its your dad%26#039;s name off of the loan through refinancing.

You can%26#039;t. Legally you have no say whatsoever in the car. The fact you made the payments means nothing in court, you could have been handed the money by her each and every time in their eyes.



Sorry, but your father needs to negotiate with her to have it titled solely in his name, and he takes possession, OR he starts making the payments with her, OR he lets it be re-po%26#039;d after she defaults on the payments and both their credit has it showing on the report.



If you want to help them both all you can do is offer to buy it from her at what%26#039;s owed on it, and take them both off the title.



If she wants to keep it, then your dad has to work it out. Since you%26#039;re not on the note or the title, you have no standing in court to take any action against her.

If it is in your dads name as well as hers.. and you have proof that she cant afford the payments and that you was the one making the payments then yes I would take her to court if she wont cooroperate... you would probabley win also.. take your dad with you.. If you are sure she couldn%26#039;t keep up on the payments then your dads credit would get ruined so yah I would fight it.. good luck to ya!

Either your Dad or your gf will have to buy out the other half, or they will have to agree to sell the whole thing and split the proceeds (if any after paying off the loan).

If her name is on the car (with your dad as a co-signer) she doesn%26#039;t have to give it to you, but you can offer to BUY it from her. You have no rights to it. When she defaults on the payments, then they%26#039;ll contact your father.
