You must have signed an agreement when you gave him the deposit. His holding the car for you meant that he couldn%26#039;t sell it to another customer. Isn%26#039;t that the point of a deposit?

If you let him know within 7 days you should be well within your legal right to a refund. i assume you came away with some paperwork after leaving a deposit? if you didnt you may have a problem, if you did then there should be a %26quot;cool off%26quot; period stated on it in which you can get your deposit back and cancel the sale. if in doubt ring trading standards, by the sounds of it the dealer is acting illegally, if they refuse to be fair, definately give trading standards a ring.

I used to work for a car dealership. The deposit you gave them is like a promise deposit. You give them the deposit %26amp; they promise not to sell the car to another party until your financing goes through.
Sadly - I suspect you are out of a deposit. If you gave them a deposit that was more than 10% of the agreed price of the car - you might be able to threaten them with a lawyer (depends on the laws in your state). But 10% or less ... and well .. they gotcha. I%26#039;m sure there is a statement about it in the order form.

Your local newspaper may have a consumer column where people write as a last resort, even after some time has gone by.

Do you not understand what a deposit is? You make a deposit to secure something, so it cannot be sold to someone else while you are completing your arrangements to finalise the purchase. It%26#039;s a down payment: a partial payment made at the time of purchase; the balance to be paid later. I%26#039;m not surprised he refused to give it back, you%26#039;ve messed him around and broken your agreement to buy.
I doubt if he%26#039;s bullying you to buy another car, that%26#039;s absolute tosh; what he%26#039;s saying is you could use the deposit you paid towards another one, which is entirely different, and in fact a generous offer - he could just tell you to push off.

You can tell them that you will be reporting them to your states DMV office or whichever government arm regulates dealers/franchise licenses. Unless your state doesn%26#039;t require refunds of deposits. Don%26#039;t let them bully you into buying another car. Get your money back!

The other posts nailed it, he can keep it, technically, you are the one at fault, and dependent on what you signed, you may in breech of contract for breaking your purchase agreement, I%26#039;d drop it.
The dealer offering you your deposit towards the purchase of another car is an offer of good faith, I don%26#039;t see that as bullying at all, he is under no obligation to do that at all, if you do want to still purchase a different car, you should look at that option to keep your deposit. (though now he has you over a barrel and it%26#039;d be much harder to negotiate your price down on a subsequent car)

Depending on what state you are in there might be a three day law. This would specific that by law you have three days to return a car from the date of purchase.
In your case you did not even take the vehicle off the lot so the dealer is playing hard ball with you.
I know that you understand that a deposit is just that and they will say that since you put a deposit down they were unable to sell the vehicle.
I would try talking with the new car general manager and see if he could help you out with your situation.
You can always call the manufactures customers service department and tell them of the situation and if you want you can file a complaint against the dealership with the manufacture and they will have to respond.
Dealerships go not want complaints filed against them with the manufacturer at all, it just looks bad for them.
