My uncle got me a car in his name about 4 years ago. My dad has been paying it for me out of his checking account since we got it. Well my Uncle passed away in October and my father tried to call the finance company to see if we could get it transferred over into my dad%26#039;s name and their saying they can%26#039;t do anything about it now, since they can%26#039;t get my uncles permission, not to mention my dad doesn%26#039;t have the best of credit to re-finance it into his name.
My uncles daughter says all of his assets have to go into probate or something, and it%26#039;s all a big mess. So is my car included in the probate? There is still $3000 left on the car and I don%26#039;t want to keep paying for it if they are not going to let us have it in the long run. If I knew I could get it in my name as soon as I pay it off then I would go ahead and pay it all off, but don%26#039;t want to waste money if they won%26#039;t let me have it. What will happen if we stop paying it, will my cousin have to pay that bill?

Sounds like it will go into probate, but you can probably make a deal with your cousin (or whoever the executor of the estate is) to buy the car from the estate. Get the $3,000 or arrange a new loan and buy the thing.

The bill for the car will probably come out of the probate. you could ask if your cousin who should be next of kin can he/she could sign the car over to you if you pay the note. Ask your cousin if he/she could ask for you.

I dont think it would be horribly wrong to stop paying the bill as long as you turn the car over to your cousin as well. She might have to pick up the payments but she is gaining all the money you put into the car so your practically giving it to her. You could proably sue the executor of your uncles estate and get either the name of the car transfered to you or some of your money back.
