Lawyers: We purchased a new car on Feb. 6, signed the contract stating we would bring a depsosit on

kept our word brought the down payment back to the dealer on Feb. 15. Kept our promise on Feb 15. Got to the dealership to hear the unexpected from the finance deposit, o we need more than this on the cashier%26#039;s check, (deposit amount is on the contract) and then they ask when can you bring the car back!!! On top of that said we did not approve you, but yet we have this contract from his company!!! Mind this, the finance guy did not take the cashier check with their name on it, and the amount is not a small amount on the check!!! We talked to the sales man who sold us the car on Feb. 16, he stated to sit tight til Feb. 18, which we still have not heard a word from anyone. Here we stand still with the new car and a large cashier check in the dealers name. What do we do?

Your car is covered by the UCC b/c it is a good. A good is a movable item identified at the time you formed the contract. Your car was the subject of the contract and is movable.



Merchant is a person who normally deal in the kind of goods. Dealer is a merchant of cars.



K formation and terms. I have no idea b/c you did not mention if the K has a conditional clause in it requiring approval of finance. You should print this to determine if there is a clause and if it valid, void, or voidable.

begin by typing up a document outlining ALL your dealings with the agency, in detail, including dates, times, names of individuals w/ whom you dealt. wait to hear from them. they may try to repossess the car; do NOT fight with any individual who may try to do that.

Call your State Attorney Generals%26#039; Office - Department of Consumer Protection, the Better Business Bureau and your local news stations to investigate this dealership. I personally think your being dragged along. Nothing like a little light and heat to bring out the cheating rats. They%26#039;ll run like a bunch of cockroaches.
